Thank you for using our services. The Services are provided by SWAP GLOBAL SIA, registered at Gustava Zemgala gatve 74, Rīga, LV-1039, Latvia, governed by the laws of the European Union. Swaptome.com is an online trading service for buying and selling cryptocurrency. Swaptome.com helps to resolve disputes if such should arise between buyers and sellers. Swaptome.com doesn’t become a party to any trade or transaction concluded by its users. Our users may be natural persons or legal entities. Please carefully review the following basic rules that govern your use of our services. Please note that your use of the Website constitutes your unconditional agreement to follow and be bound by these Terms and Conditions of Service. If you do not agree to them, do not use the Website.

Description of Services

Swaptome.com is a peer-to-peer platform service that enables its users to buy and sell digital currency. The Site allows buyers and sellers to buy and sell the blockchain-based currency. Swaptome.com also offers hosted digital wallet services. Our registered users are able to post offers to either buy or sell digital currency via payment methods of their choice. The creator of the offer is responsible for listing terms of the trade. Once an offer is selected by another user, digital currency is held in our escrow service from the party that is selling it. The digital currency is released from escrow to the buyer by the seller once the buyer has completed the terms of the trade. The escrow is released back to the seller if the buyer chooses to cancel the trade. The seller may not cancel the trade at any point. The seller only has the option to release the digital currency from escrow to the buyer. This is for the security purposes of the buyer. Should a seller need to cancel the trade due to a buyer not following the terms of the trade, they must start a dispute and provide a reason for doing so. Swaptome.com also provides an online digital asset trading platform (crypto to crypto) for products commonly known as cryptographic currency. Swaptome.com does not provide fiat trading capabilities on its platform and as such is not subjected to the stringent regulations that come with it. Swaptome.com functions as a trading platform provider and is not a buyer or seller in trades made between traders. Swaptome.com is also not a market maker.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Prohibited Uses

You may use the Website for the sole purpose of sharing and exchanging ideas with other Users. You may not use the Website to violate any applicable local, state, national, or international law, including without limitation any applicable laws relating to antitrust or other illegal trade or business practices, federal and state securities laws, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, and any U.S. laws, rules, and regulations governing the export and re-export of commodities or technical data.

You may not upload or transmit any material that infringes or misappropriate any persons copyright, patent, trademark, or trade secret, or disclose via the Website any information the disclosure of which would constitute a violation of any confidentiality obligations you may have.

You may not upload any viruses, worms, Trojan horses, or other forms of harmful computer code, nor subject the Websites network or servers to unreasonable traffic loads, or otherwise engage in conduct deemed disruptive to the ordinary operation of the Website.

You are strictly prohibited from communicating on or through the Website any unlawful, harmful, offensive, threatening, abusive, libelous, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable material of any sort, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law.

You are expressly prohibited from compiling and using other Users personal information, including addresses, telephone numbers, fax numbers, email addresses or other contact information that may appear on the Website, for the purpose of creating or compiling marketing and/or mailing lists and from sending other Users unsolicited marketing materials, whether by facsimile, email, or other technological means.

You also are expressly prohibited from distributing Users; personal information to third-party parties for marketing purposes. The Operators shall deem the compiling of marketing and mailing lists using Users; personal information, the sending of unsolicited marketing materials to Users, or the distribution of Users; personal information to third parties for marketing purposes as a material breach of these Terms and Conditions of Use, and the Operators reserve the right to terminate or suspend your access to and use of the Website and to suspend or revoke your membership in the consortium without refund of any membership dues paid.

The Operators note that unauthorized use of Users; personal information in connection with unsolicited marketing correspondence also may constitute violations of various state and federal anti-spam statutes. The Operators reserve the right to report the abuse of Users; personal information to the appropriate law enforcement and government authorities, and the Operators will fully cooperate with any authorities investigating violations of these laws.

Termination

These Terms and Conditions of Use are effective until terminated by either party. If you no longer agree to be bound by these Terms and Conditions, you must cease use of the Website. If you are dissatisfied with the Website, their content, or any of these terms, conditions, and policies, your sole legal remedy is to discontinue using the Website.

The Operators reserve the right to terminate or suspend your access to and use of the Website, or parts of the Website, without notice, if we believe, in our sole discretion, that such use is in violation of any applicable law; is harmful to our interests or the interests, including intellectual property or other rights, of another person or entity; or where the Operators have reason to believe that you are in violation of these Terms and Conditions of Use.

Identity Verification

In order to ensure Swaptome.com remains a safe platform for all of our users, and for us to comply with mandatory legal obligations which we are subjected to, we may require you to verify your identity to access the services we offer.

Identity verification may be required when you create advertisements, during trade disputes, fraud investigations, and to ensure account ownership. As part of our ID verification process we require you to provide us with your full name, email and phone number.

Disputing Trades

When a buyer and a seller are in disagreement over a trade either party or Swaptome.com can start a dispute to initiate a mediation process on the digital currency held in escrow. Disputed trades are reviewed and resolved by Swaptome.com support staff. Disputes can only be started on trades that are open and marked as paid by the buyer but not yet released by the seller. Trades that are not marked as paid by the buyer, have been released by the seller, cancelled by the buyer, automatically cancelled, or already disputed and resolved are considered completed and cannot be disputed, reversed, or altered

Dispute resolution criteria

Swaptome.com can resolve a disputed trade in the favor of a digital currency buyer when one of the following criteria are met: The buyer has made payment according to the instructions provided by the seller in the trade chat, advertisement terms of trade, or advertisement payment details and the buyer has provided sufficient proof that the payment was made according to these instructions. The seller has become unresponsive. Swaptome.com can resolve a disputed trade in the favor of a digital currency seller when one of the following criteria are met: The buyer has not provided payment or not provided payment in full The payment made by the buyer has been held/frozen/stopped by the payment provider The buyer has not provided payment according to the instructions provided to them by the seller in the trade chat, advertisement terms of trade or advertisement payment details. The buyer is not responding If the buyer or the seller of a disputed trade provides fraudulent information or fraudulent documents or makes false claims or otherwise tries to force a certain outcome of a disputed trade the dispute may be immediately resolved against the user

Limitation of Liability regarding dispute resolution

You acknowledge that the dispute resolution is a service that we provide and which will be conducted in accordance with the terms of this Agreement. You agree and accept that we assume no responsibility for the outcome thereof and in any event our liability for dispute resolution is limited to the amount of fee payable to us. In the event of an incorrect dispute resolution which is corrected in accordance with the terms of this Agreement, we assume no liability for any damage, costs or inconvenience.

Disclaimer of Warranties and Limitation of Liability

This site and the services are provided on an “as is” and “as available” basis without any representation or endorsement. To the maximum extent permitted by applicable law, we make no warranties of any kind, whether express or implied, in relation to the site or the services, including but not limited to, implied warranties of fitness for a particular purpose or non-infringement, or any implied warranty arising from course of dealing or usage.

Swaptome.com is not associated with or does not itself support or claim to be in partnership with any of the payment methods, services or companies which may appear visible in the Online Payment method lists or advertisement details. Also, services provided by Swaptome.com are not authorized, approved, endorsed or sponsored by any of the payment methods listed on the website or their respective trademark owners. Swaptome.com is not responsible for any user-generated content on its site including but not limited to messages, feedbacks or advertisements and may remove said content without notice (unless such notice is required by applicable law) or liability at any time in its sole discretion. Swaptome.com reserves the right to modify or discontinue, temporarily or permanently, all or any part of this site and/or any services on this site, with or without notice, and/or to establish general guidelines and limitations on their use. Our liability, and the liability of our affiliates, directors and employees, is limited to the maximum extent permitted by applicable law. In particular, we will not be liable for indirect damage. Nothing in this Agreement shall exclude or limit our liability based on willful misconduct or gross negligence. Notwithstanding any other provision in this Agreement, nothing shall limit your rights as a consumer under mandatory provisions of applicable consumer protection legislation which are relevant for our services.

For all purposes, the English language version of this user agreement shall be the original, governing instrument. In the event of any conflict between the English language version of this user agreement and any subsequent translation into any other language, the English language version shall govern and control.
